Contracts and Trade Compliance Manager
Job Description:

Manage compliance with local, federal and foreign regulations governing export control in support of Commercial sales (non-military use), Foreign Military Sales (FMS) and Direct Commercial Sales (DCS) of items intended for Military use.  Manage all aspects of licensing the import, export and sale of firearms and destructive devices under license from the Bureau of Alcohol, Tobacco, Firearms and Explosives.  Manage compliance with the Foreign Corrupt Practices Act (FCPA) and the Federal Acquisition Regulations (FARs).  The successful candidate should have strong exposure to compliance with ITAR, EAR and BATFE regulations, and appropriate credentials applicable to Export, Import and International arms traffic.

 

DUTIES AND RESPONSIBILITIES

  • Subject Matter Expert (SME) for export activity and import/export/sale of firearms and munitions.
  • Prepares License applications and other documentation related to export of products and import/export and sale of firearms and munitions.
  • Excellent working knowledge of ITAR and EARs.  Excellent working knowledge of firearms and munitions licensing regulations.
  • Acts as liaison with representatives within the United States Departments of State and Commerce; US Customs and Border Patrol; and Bureau of Alcohol, Tobacco, and Firearms (BATFE) to resolve problems.
  • Develop effective and constructive solutions to challenges and obstacles in licensing and export activity and procedures.
  • Preparation, administration and status of appropriate documents for exports and sales of firearms and munitions.
  • Update the company’s export control, firearms, anti-corruption, data security and other compliance policies and procedures and provide training to all affected functions within the company.
  • Advises management of contractual rights and obligations to manage risk, meet compliance standards and to ensure meeting internal and external customer requirements.
  • Prepare, administer, create and negotiate contracts, non-disclosure agreements, sales agreements, bailment agreements, rough order of magnitude, professional service agreements, non-disclosure agreements, terms and conditions, purchase agreements, subcontracts and other agreements including writing clauses, interpreting performance requirements, delivery obligations, schedules and related terms and conditions. 
  • Act in lead capacity to manage the day-to-day operations of the property administration system to ensure compliance with company directives and regulatory requirements.
  • Perform/lead property management activities regarding physical inventory, contract close out, and disposition of program assets and material to include demilitarization, bid sales, recycling, and donations.
  • Serve as main point of contact with DCMA Government Property Administrators, Property Management team members, and site personnel.
  • Other duties may be assigned.

Carries out supervisory responsibilities in accordance with the organization&39;s policies and applicable laws.

Job Requirements:

SKILLS AND ABILITIES

  • Thorough knowledge of U.S. Government export regulations (ITAR, EARs, OFAC) is required.
  • Knowledge of U.S. Government Contract laws, regulations and processes (FAR, DFARs, UCC, & common law contract formation) is required.
  • Familiarity with BATFE regulations is required.
  • High degree of accuracy and attention to detail is required.
  • Ability to influence across functions and interact with individuals at all levels.
  • Strong organizational and work management skills required.
  • Ability to achieve results through supervision and management of subordinates.
  • Demonstrated ability to analyze and assess legal risk and compliance issues.
  • Proficiency in Microsoft Word, Excel, PowerPoint and Outlook skills required.
  • The ability to understand and follow instructions and the ability to concentrate is required.
  • Excellent written, verbal, communication and interpersonal skills.
  • The ability to get along with others and to be part of a team.
  • Ability to access Export Control and other regulatory information.
  • Regular attendance at the worksite.

 

EDUCATION and/or EXPERIENCE

  • Bachelor's degree (B. S.) from four-year college or university and 4 years work-related experience and/or training; or equivalent combination of education and experience.
